Agreement to Terms

By accessing or using The Circle - Language Learning Network mobile application ("The Circle," "the App," or "our services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and Quiva Connect ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and your continued use of the services after such modifications constitutes acceptance of the updated Terms.

Eligibility

You must be at least 13 years old to use The Circle. By using our services, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and truthful

Account Registration

To use certain features of The Circle, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Acceptable Use

You agree to use The Circle only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm other users
• Post, transmit, or share any content that is illegal, harmful, threatening, abusive, or discriminatory
• Impersonate any person or entity or falsely claim affiliation with any person or entity
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated systems (bots, scrapers) to access or interact with our services
• Reverse engineer, decompile, or attempt to extract the source code of The Circle
• Interfere with or disrupt the integrity or performance of our services

User Content

The Circle allows you to post, share, and exchange content with other users. You retain ownership of any content you create, but by posting content on The Circle, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and promoting our services.

You are solely responsible for the content you post. We reserve the right to remove any content that violates these Terms or is otherwise objectionable, at our sole discretion.

Intellectual Property Rights

The Circle and all its content, features, and functionality (including but not limited to text, graphics, logos, icons, and software) are owned by Quiva Connect and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

Service Availability

We strive to provide reliable and continuous access to The Circle, but we do not guarantee that the services will be available at all times or free from errors, interruptions, or security vulnerabilities. We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice.

Termination

We may terminate or suspend your account and access to The Circle immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use our services will cease immediately.

You may also terminate your account at any time by contacting us or using the account deletion features within the App.

Disclaimers

THE CIRCLE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that The Circle will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not guarantee the accuracy, completeness, or usefulness of any information provided through our services.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIVA CONNECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE CIRCLE.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of The Circle after such modifications constitutes acceptance of the updated Terms.

Governing Law
